TERMS & CONDITIONS
SERVICE
- Every
endeavour will be made to meet the requirements of the Customer from the information
supplied by them.
- The
acceptance of a Quote will be taken to constitute a legally binding
contract subject to these Terms and Conditions.
- The
acceptance of a formal Service & Maintenance Contract will be taken to
constitute a legally binding contract subject to these Terms and
Conditions.
- Any
variation of the Service & Maintenance Contract must be made in
writing and signed by both the Engineer and the Customer.
- Where
the Engineer himself is unable to attend site, for whatever reason, every
attempt shall be made to ensure that a suitably qualified and experienced
replacement attends site at the earliest opportunity.
- In
the event of either:
a)
The Engineer being delayed in or prevented from completing a contract
due to an act of god, force majeure, war, civil
disturbance, requisitioning, government or parliamentary restriction,
prohibition or enactment of any kind, import or export regulations, trade
dispute, difficulty in obtaining materials or workmen, breakdown of machinery,
shortage of fuel, fire, accident or any other cause whatsoever beyond the
Engineer’s control, or
b)
Non delivery by the Engineer’s suppliers,
The Engineer shall be at liberty to suspend or cancel the
contract without incurring any liability, loss or damage resulting therefrom.
- While
delivery dates for replacement parts are given in good faith based upon
information available to the Engineer at the time of the quotation, such
dates are not guaranteed, and the Engineer accepts no liability for delay. Nor shall such delay entitle the
Customer to repudiate the contract or to claim any damages or compensation
in respect of the said delay.
- Where
goods / spare parts are ordered for delivery direct to the Customer,
delivery will be said to have taken place when the goods are delivered to the
Customer’s premises. The Engineer
accepts no responsibility for any loss or damage to goods / spare parts,
howsoever arising, after delivery to the Customer has taken place. Claims in respect of loss or damage in
transit should be made direct to the Carrier concerned.
PRICES
- It
is our intention to hold prices for as long as possible. However, prices are based upon the cost
of labour, transport, fuel and other relevant factors applying, including
statutory obligations at the time of the quotation; and if between the
date of the quotation and the date of the service, variation either by
rise or fall shall occur in these costs, then we reserve the right to
amend the contract price to provide for these variations.
- Hourly
labour rates are charged at a minimum of 30 minutes and in 15 minute
intervals thereafter.
- A
Call Out Charge will apply to all visits unless otherwise stated
- Quotations
will be held for 30 days.
- Unless
otherwise stated, spare parts will be charged in addition to the call-out
and hourly labour charges.
VAT
- All
prices quoted are exclusive of VAT unless otherwise stated.
TERMS OF PAYMENT
- To
customers under Service & Maintenance Contracts, strictly nett 30 days from date of invoice.
- All
other customers, payment within 14 days.
- We
reserve the right to charge interest on all overdue accounts at 5% above
current bank rates.
- Failure
to pay for any service or goods shall entitle the Engineer to suspend
further work both on the same contract and on any other contract from the
Customer, without prejudice to any other right the Engineer might have.
- We
reserve the right, where a Customer fails to adhere to the agreed Credit
Terms or where genuine doubt arises as to a Customer’s financial position,
to suspend work without liability until payment or satisfactory security
for payment has been provided.
TITLE TO GOODS
- Title
to goods, including spare or replacement parts, does not pass to the
customer until the account is settled in full.
GUARANTEE
The services undertaken by this engineer are supplied with
the following express guarantee: All
precautions are taken to ensure the quality of materials and workmanship
against faulty materials or workmanship for a period of 3 months from the date
of service.
Under no circumstances will the engineer accept
responsibility for any defects whatsoever arising from misuse of any equipment,
or arising from situations outside the engineer’s control. This guarantee shall not apply to any defects
in any goods that have been altered by customers or third parties. Any claims made hereunder must be made within
30 days of discovery of the defect.
